Mall Shooting Victim Sues Owners and Security Company for Negligence in Indiana

GREENWOOD, Ind. – A woman injured during a mass shooting at the Greenwood Park Mall in July 2022 is now suing the mall’s owner and security company for negligence. The lawsuit alleges that the mall and security agency failed to prevent the shooting, resulting in severe and life-threatening injuries to the plaintiff, Kaya Stewart, and others present at the time of the incident.

Attorneys for Stewart and her family filed the lawsuit in Marion County Superior Court 1 against Simon Property Group and Allied Universal Event Services. The shooting, which took place in Johnson County, was filed in Marion County due to the location of Simon and the registered agent of Allied. The suit accuses both organizations of negligence and gross negligence.

The lawsuit claims that on July 17, 2022, a 20-year-old gunman entered the mall with a bag of guns and opened fire near the food court, killing three people and injuring several others, including Stewart. The lawsuit alleges that the mall and security agency failed to take reasonable steps to prevent the shooting from occurring, including inadequate security personnel training and a lack of monitoring in key areas of the mall.

Stewart’s attorneys are seeking compensation for economic damages, including medical expenses and lost wages, as well as non-economic damages such as pain and suffering.
