TOPEKA, Kan. – The Kansas Supreme Court has upheld the convictions and death sentence of Kyle Flack for the 2013 murders of K.B. and L.B., Steven White, and Andrew Stout. Flack was found guilty of capital murder, first-degree murder, second-degree murder, and criminal possession of a firearm in 2016. Following the conviction, he appealed to the Kansas Supreme Court on June 16, 2022, and oral arguments took place on January 31, 2022.
In response to the court’s decision, Kansas Attorney General Kris W. Kobach expressed his support for the affirmation of the convictions and death sentence. He stated, “The Court’s decision today brings the victims’ families one step closer to seeing justice served. It is unfortunate it took the court almost 24 months to issue this decision. Justice delayed is justice denied.”
Deputy Attorney General Vic Braden and former Franklin County Attorney Stephen Hunting were the prosecutors in the case. Braden emphasized that the jury carefully considered all evidence and factors before determining that death was the appropriate justice for Flack’s crimes. The Franklin County Sheriff’s Office led the investigation into the murders, with assistance from various law enforcement agencies and units.
The Kansas Supreme Court’s decision concludes the direct appeal in this case, unless the defendant successfully requests the U.S. Supreme Court to review it. In the absence of such a request, Flack remains convicted of capital murder and the death sentence stands as justice, as determined by the Franklin County jury.
