Verdict: Shelby County Jury Finds Randall Gargone Guilty of Capital Murder

Jurors in Shelby County, Alabama returned a verdict of guilt for Randall Gargone, who was accused of brutally killing 68-year-old Tracey Austin. The trial, which began last week with opening statements, saw Gargone take the stand to testify in his defense. He claimed that he killed Austin in self-defense, alleging that the victim had attacked him first with a hammer. Gargone also stated that he saw a knife and began stabbing Austin until he dropped the hammer, at which point Gargone picked it up and continued hitting Austin. He then admitted to leaving the home and disposing of the knife.

However, the state presented evidence showing that deputies never found the weapon Gargone claimed to have left behind. Additionally, prosecutors highlighted that Gargone had conducted a web search for “how long does it take for DNA results to come back” and had texted his son about having a plan and not worrying about money before and after the victim was killed.

In the closing arguments, the state emphasized the brutality of the crime, questioning the necessity of stabbing someone 14 times if it was truly an act of self-defense. On the other hand, the defense argued that the evidence did not align with Gargone’s account and urged the jury to find him not guilty.

After deliberating for approximately an hour, the jury found Gargone guilty of capital murder. As a result, he now faces the possibility of the death penalty. The sentencing phase of the trial is forthcoming.
