Investigators say surveillance video, payment records and a witness statement helped identify the 20-year-old defendant.
AUSTIN, Texas — A man waiting for a ride in Austin’s Rainey Street entertainment district was shot multiple times after chasing someone who had taken his hat and vape, according to court records describing the July 26 confrontation.
Police arrested 20-year-old Bryan Andrew Bouray of Pflugerville on Aug. 1 and charged him with aggravated robbery with a deadly weapon. The charge is a first-degree felony allegation. Bouray is accused of taking the property before shooting the man during the ensuing encounter. The accusation has not been proven in court.
Austin police were called to 80 Rainey Street at about 1:23 a.m. after several people reported gunfire. Officers found a man with multiple gunshot wounds and used a tourniquet on his upper left arm before paramedics took him to a hospital. Police later said his injuries were serious but not considered life-threatening.
Investigators found several .45-caliber cartridge casings near the shooting scene, according to the court records. The injured man told detectives that he had been sitting on a bench and waiting for a rideshare while speaking with two men. He believed the men might have been brothers or cousins.
The records say one of the men suddenly pulled the victim’s hat from his head and ran. The victim chased the pair in an effort to recover it. During that pursuit, one of the men displayed a handgun and fired several times, the victim told police.
Surveillance recordings from nearby businesses provided investigators with a more detailed sequence. The footage reportedly showed the two men approaching the bench and speaking with the victim. The victim allowed one man to use his vape, which was then passed to the other man.
According to the affidavit, the second man took several hits from the vape and began to walk away. The victim reached toward him, and the man pushed the victim’s arm aside before taking the hat and running with both items. The footage then showed the victim pursuing the men.
A pedicab driver contacted police on July 28 after seeing images released by investigators. The driver said he believed he had transported the two men from East Sixth Street to Rainey Street on the night of the shooting. He gave detectives a record of a Cash App transaction connected to the ride.
Two days later, the person initially described by police as another suspect contacted detectives and identified himself as one of the men shown in the released images. He gave a statement and identified Bouray as his friend, according to the affidavit.
The witness told investigators that Bouray had met the victim earlier that night near an IHOP and spent time walking around with him. The men later separated, but Bouray and the witness encountered the victim again while walking on Rainey Street.
The witness said they used the victim’s vape because the battery in his own device was dead. He told detectives that Bouray then grabbed the victim’s hat and ran. The witness said he followed because he was frightened as the victim chased them.
According to the witness’s account, the victim caught up and punched Bouray in the face. The witness said Bouray then pulled out a gun and fired multiple shots before the witness ran from the area. Police have not accused the witness of participating in the robbery or shooting.
Detectives compared Bouray’s driver’s license photograph and identifying information with surveillance images, descriptions provided by the victim and witness, and other evidence collected during the investigation. Police said officers recovered several pieces of evidence, including a firearm, while carrying out arrest and search warrants.
Bouray’s bond was set at $50,000, according to the local report based on court records. He later posted bond and was released under house-arrest conditions. Court records available through the reporting did not establish when his case would next be heard.
