The victim survived after being shot twice in the back, police said.
ORANGE CITY, Fla. — A Volusia County judge denied bond Monday for Joseph Aviles, a 21-year-old man accused of shooting a stranger after an argument outside an Orange City store Saturday morning.
The ruling keeps Aviles in jail while prosecutors move ahead with an aggravated battery case. Police said the shooting happened outside an Ollie’s Bargain Outlet after a brief confrontation that witnesses described as winding down before gunfire erupted.
According to investigators, Aviles approached the victim outside the business and made a comment that sparked a verbal argument. Police said Aviles later got into the passenger side of a vehicle and fired three shots. The victim was hit twice in the back.
Witnesses told police the vehicle left after the shooting. Investigators later located the woman who had been driving. Authorities said she has cooperated with police and had her young son in the vehicle at the time of the shooting.
Police said the woman and child had been shopping for items for the child’s fourth birthday party. Officials said no charges had been filed against her. Police have not said that the victim and Aviles knew each other before the encounter.
In court, Aviles’ attorney sought a $150,000 bond and proposed limits that would bar contact with the victim and access to firearms. The judge rejected the request, pointing to the firearm allegation and the severity of the shooting.
The victim survived and is recovering after surgery. Authorities have not released his name or detailed condition. The case remains active, with investigators still reviewing witness accounts and the events leading up to the gunfire.
Aviles is due back in court next week. As of Tuesday, he remained held without bond, and no additional charges had been announced publicly.
